HelloYada, Inc. ("Yada," "we," "us," or "our") takes the private nature of your information very seriously. We have prepared this policy (the "Privacy Policy") to describe to you our practices regarding the personal information we collect from users of our websites, https://yada.land and https://helloyada.com (the "Sites"), our applications ("Applications"), and online services (together with the Sites and Applications, the "Services").

Personal Information We Collect

We collect information about you in a range of forms, including personal information. Personal information is information that identifies you, including, for example, your name, email address or telephone number.

Information You Provide To Us. We collect information that you provide to us through the Services or otherwise communicate to us, including:

  • Contact and registration information, such as yourgender, birthdate, age, email address, phone number, username and password when you register for or create an account on the Services ("Account").
  • User content, such as information and content that you share or publish through the Services, including when you comment on a post, save a post, reply to a comment, and follow an account. In some cases, we may collect information about certain types of content you provide to the Services. For example, when it's included as part of your images, we may collect information describing your camera, camera settings, or EXIF information.   • Location information, such as when you tell us where you are or allow your mobile device to send us your location.
  • Profile and preferences information, such as how your content is displayed and your preferences for receiving marketing communications from Yada.
  • Feedback and correspondence, such as your name, email address and any other information you provide when you contact us or report a problem with the Services.
  • Contact lists, such as the phone numbers of mobile contacts that you send to us or allow us to access when you invite friends to the Services or share content with them. See the Inviting and Findings Friends section below for more information.
  • Survey information and responses, such as your profile or contact information and responses to survey questions.
  • Sweepstakes, contests and giveaway information, such as your contact information and other details you may provide when entering a contest.

User Content.When you post content (text, images, photographs, messages, comments or any other kind of content) on our Services, the information contained in your posting will be stored in our servers and other users may be able to see it, along with your username, profile image and any other information that you choose to make public on your public profile page (collectively "Profile"). Content published and shared publicly is accessible to everyone, including search engines and anonymous users, and we do not have control over third parties who may copy or share content that you make available to the public.

Inviting and Finding Friends. If you decide to invite a friend to use the Services or search for existing contacts that have already created an Account, we will collect your and the third party's contact information that you provide or allow us to access. We rely upon you to obtain whatever consents from the third party that may be required by law to allow us to access and upload the third party's name and email address as required above. You or the third party may contact us at support@helloyada.com to request the removal of this information from our database.

Information From Third Party SitesOur Services may include interfaces that allow you to connect with third party sites, such as when you create an Account on our Services by logging in using another site's account information. If you connect to a third party site through the Services, you authorize us to access, use and store the information that you agreed the third party site could provide to us based on your settings on that third party site. We will access, use and store that information in accordance with this Privacy Policy. You can revoke our access to the information you provide in this way at any time by amending the appropriate settings from within your account settings on the applicable third party site.

Information Collected Automatically.We may automatically log information about you and your computer or mobile device when you access or use the Services. For example, our servers may automatically get information about your device, such as your device ID, browser type, operating system, IP, domain name, and/or a date/time stamp for your visit. We may also collect information about your use of and actions on the Services, such as the website you visited before browsing to our Sites, pages you viewed, how long you spent on a page, access times, general location information such as city, state or geographic area, and similar information. Information We Get From Others.We may receive information about you from other sources, for example, from a third-party information provider or if you have agreed to share information with one of our partners. We may also receive personal information about you from companies that provide our Services. We may add this information to the information we have already collected from you in order to improve the Services we provide.

We collect information using cookies and similar tracking technologies on our Services. Cookies are small data files stored on your device when you visit a website. Cookies serve different purposes, like helping us understand how our Services are being used, letting you navigate between pages efficiently, remembering your preferences, and generally improving your browsing experience. Analytics

Social

Pixel Tags.In addition, we may use pixel tags (also referred to as clear GIFs, web beacons, or web bugs) on our websites to track the actions of users on our websites. Pixel tags are tiny graphic images with a unique identifier, similar in function to cookies, which are used to track online movements of web users. In contrast to cookies, which are stored on a user's computer hard drive, pixel tags are embedded invisibly in web pages. Pixel tags also allow us to send e-mail messages in a format users can read, and they tell us whether e-mails have been opened, for example, to ensure that we are sending messages that are of interest to our users. How We Use Your Personal Information

We use your personal information for the purposes described below and as otherwise described to you in this Privacy Policy or at the time of collection.

To Provide You With the Services and Respond to Your Requests. We use your personal information to provide you with the services you request, including to register and secure your Account, respond to your inquiries, and communicate with you regarding Yada and our Services, such as by sending you announcements, updates, and administrative messages.

To Operate and Improve the Services. We use the information that we collect to operate, maintain, administer and improve the Services, and to better understand your needs and interests and personalize your experience with the Services. We also use your information for research and development purposes to improve the quality of experience when you and other users interact with our Services.

To Send You Surveys and Marketing Communications. We may send you surveys, promotions or other marketing communications, but you may opt out of receiving them as described in the Your Choices section below.

To Create Anonymous Data. We may create aggregated and other anonymous data from our users' information. We make personal information into anonymous data by removing information that makes the data personally identifiable. We may use this anonymous data and share it with third parties for our lawful business purposes.

For Compliance, Fraud Prevention and Safety. We may use your personal information as we believe appropriate to (a) investigate violations of and enforce our Terms of Use; (b) protect our, your or others' rights, privacy, safety or property (including by making and defending legal claims); and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

For Compliance With Law. We may use your personal information as we believe appropriate to (a) comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities; and (b) where permitted by law in connection with a legal investigation.

We disclose your personal information as described below and as described elsewhere in this Privacy Policy.

Third Parties Designated by You.When you use the Services, the personal information you provide will be shared with the third parties that you designate to receive such information, including other websites, social networking services, your friends and other users.

Other Users. We will share your personal information with other users solely for the purpose of providing the Services.

Service Providers. We may share your personal information with third party companies and individuals as needed for them to provide us with services in support of the Services (such as hosting and storage, website analytics, email delivery, marketing, database management services and legal and other professional advice). These third parties will be given limited access to your personal information that is reasonably necessary for them to provide their services.

Affiliates. We may share some or all of your personal information with our parent company, subsidiaries, joint ventures, or other companies under a common control ("Affiliates"), in which case we will require our Affiliates to honor this Privacy Policy.

Compliance, Fraud Prevention, Safety. We may disclose your personal information as we believe appropriate to government or law enforcement officials or private parties for the purposes described above under the following sections: For Compliance, Fraud Prevention and Safety and For Compliance With Law.

Business TransfersWe may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business deal (or potential business deal) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution.

Your Choices

In addition to your choices in connection with cookies (see Cookies and Similar Technologies ), you have several choices regarding use of information with respect to our Services:

Marketing Communications. We may periodically send you information, notifications, texts or emails that directly promote the use of our Services. When you receive newsletters or promotional email communications from us, you may indicate a preference to stop receiving further marketing communications such as by following the unsubscribe instructions provided in the communication you received, by changing your Account or device settings, or by contacting us directly at support@helloyada.com. You may continue to receive service-related and other non-marketing emails.

Changing or Deleting Your Personal Information. You may change any of your personal information in your Account by editing your profile, changing your Account settings, or by sending an email to us at support@helloyada.com. You may request deletion of your personal information by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). In addition, copies of user content that you choose to publish and share on the Services may remain even after your Account is deleted. When we delete any information, it will be deleted from the active database, but may remain in our archives. We may also retain your information for fraud or similar purposes.

Location Information.You can stop all collection of information through the Applications by following the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You may at any time opt-out from further providing us with your location data through the Applications by going to your device settings and turning off Location Access for Yada.

Choosing Not to Share Your Personal Information. Where we are required by law to collect your personal information, or where we need your personal information in order to provide the Services to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with the Services. We will tell you what information you must provide to receive the Services by designating it as required or through other appropriate means.

Other Important Privacy Information

Security. The security of your personal information important to us. We take a number of organizational, technical and physical measures designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the absolute security of your personal information. We will comply with applicable laws and regulations requiring that we notify you in the event your personal information is compromised as a result of a breach of our security measures.

Third Party Sites and Services. Our Services may contain links to third party sites and services. When you click on a link to any other website or location, you will leave our Services and go to another site and another entity may collect personal and/or other information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of your personal information after you click on links to such outside websites. We encourage you to read the privacy policies of every website you visit. The links to third party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content or websites.

A Note to Users Outside of the United States. HelloYada, Inc. is headquartered in the United States and operates a U.S. website subject to U.S. laws, including those governing the privacy and security of your information. Your personal information may be collected, used and stored in the United States or other locations outside of your state, province, country or other governmental jurisdiction, where data protection laws may not be as protective as those in your jurisdiction. We will protect your personal information as described in this Privacy Policy.

Children. Children under the age of 13 are not permitted to use the Services or register for an Account, and our Services are not directed to or intended for such users. If we become aware that a child under 13 has submitted personal information to us, we will attempt to delete their information as soon as possible. If you believe we may have personal information of a child under the age of 13, please contact us at support@helloyada.com.

Changes to This Privacy Policy. We reserve the right to modify this Privacy Policy at any time. If we make changes to this Privacy Policy we will post them on the Services and indicate the effective date of the change. If we make material changes to this Privacy Policy we will notify you by email or through the Services.
